Adopted the Draft Law on Amendments to the Law on Electronic Commerce

At the Government of the Republic of Serbia meeting on May 20th, have adopted the Draft Law on Amendments to the Law on Electronic Commerce.

This law further regulates the legal framework for electronic commerce in the Republic of Serbia, and carried further alignment with the EU regulatory framework, in particular the Directive on E-Commerce Directive (Directive 2000/31/EC).

Over the last three years of the adoption of the Law on Electronic Commerce have been some ambiguities and gaps in the implementation of the said Law. Accordingly, it is followed by the review of the design and to refine the norms and integration into the market and the legal framework of the Republic of Serbia.

The current Law on Electronic Commerce contained unnecessary and imprecise definitions which created confusion and not a clear confine of other system law. Draft Law on Amendments to the Law on Electronic Commerce, made a technical correction and clarification of certain institutes, in order to avoid interpretations that can bring legal uncertainly. Also, the Draft envisions the introduction of new mechanisms of protection providers of information society services.

Precise definition of certain terms and harmonization with other legislation has positive influence to increase the competitiveness and attractiveness of our markets in the area of electronic commerce. Specify information about the data or illicit activities and the introduction of restrictive measures on information society services impact on increasing legal certainty in this area.

Bearing in mind that these legislative amendments contribute to further harmonization with the EU regulatory framework, and to contribute to the elimination of the uncertainties and obstacles, it is logical to expect increased activity entered and the number of entrepreneurs in the field of e-trade. Arrival of PayPal payment service over the Internet in Serbia tens of thousands of people for only a month opened an account and bought goods from abroad. In  the future, is expected to launch services receiving money through PayPal to the payment of goods and services may be carried out smoothly and Serbia.
